1) When you apply to us to open an account, this organisation will check the following records about you and others (see 2 below):
a) Our own database;
b) Those at credit reference agencies (CRAs). When CRAs receive a search from us they will place a search footprint on your credit file that may be seen by other lenders. They supply to us both public (including the electoral register) and shared credit and fraud prevention information;
c) Those at fraud prevention agencies (FPAs).
We will make checks such as; assessing this application for credit and verifying identities to prevent and detect crime and money laundering. We may also make periodic searches at CRAs and FPAs to manage your account with us.

2) If you are making a joint application or tell us that you have a spouse or financial associate, we will link your records together so you must be sure that you have their agreement to disclose information about them. CRAs also link your records together and these links will remain on your and their files until such time as you or your partner successfully files for a disassociation with the CRAs to break that link.
3) Information on applications will be sent to CRAs and will be recorded by them. Where you borrow from us, we will give details of your accounts and how you manage it/them to CRAs. If you borrow and do not repay in full and on time, CRAs will record the outstanding debt. This information may be supplied to other organisations by CRAs and FPAs to perform similar checks and to trace your whereabouts and recover debts that you owe. Records remain on file for 6 years after they are closed, whether settled by you or defaulted.
4) If you give us false or inaccurate information and we suspect or identify fraud we will record this and may also pass this information to FPAs and other organisations involved in crime and fraud prevention.
5) If you have borrowed from us and do not make payments that you owe us, we will trace your whereabouts and recover debts.
6) Your data may also be used for other purposes for which you give your specific permission or, in very limited circumstances, when required by law or where permitted under the terms of the Data Protection Act 1998.

What is Open Banking?
Open Banking is the secure way of providing access to your bank or building society account to providers who are registered for this purpose.
Registered providers and participating banks and building societies are listed under the Open Banking Directory.
Open Banking was set up by the UK Government to encourage more competition and innovation in the financial services sector.
As a forward thinking lender, we support the use of Open Banking as it allows us to process loan applications efficiently, securely and in our consumer’s best interests.
By permitting access to your bank or building society account information we are able to make a better lending decision as we shall be able to verify your income, outgoings and other matters in order to assess what loan terms would be suitable for you based upon what you can reasonably afford to repay.

How will my personal data be shared and used for the purposes of Open Banking?
By proceeding with your loan application via our website you expressly consent to us sharing your personal, contact and loan application details (“the Shared Personal Data”) with our registered Open Banking partner, Perfect Data Solutions Limited (“PDS”) who are also a credit reference agency. During your loan application we shall safely and securely direct you to PDS’s secure portal (“the Portal”) for the purposes of granting PDS access to your bank or building society account information (“Transaction Information”). As soon as your Transaction Information is received it shall be reported back to us in the form of a completed search in order that we may continue to process your loan application (“the Permitted Purpose”).

Is Open Banking secure?
PDS are registered under the Open Banking Directory as an account information service provider and are also regulated by the Financial Conduct Authority as a payment services firm under number 802599. Any data you submit via the Portal will be encrypted and its usage tracked as part of set Open Banking data security standards.
We are responsible for the secure transmission of any Shared Personal Data to PDS, for safely directing you to the Portal and for the safe receipt and usage of your Transaction Information.
You will not be required to share your banking password or log in details with either us or PDS. Once you have given your explicit consent to share your bank account information on the Portal you will be directed to your own bank or building society’s login page where you will enter in your own login details directly.
How will my Shared Personal Data and Transaction Information be used?
PDS shall be entitled to re-access your Transaction Information for up to 90 days from the date of your original search result in order to refresh the search results, obtain a snapshot of your data or gather additional data.
As PDS are also a credit reference agency they may also share and keep a record of your Shared Personal Data and Transaction Information.
Will you use my Transaction Information data for any other purpose?
The Transaction Information we receive about you will only be used for the Permitted Purpose. We do not sell or share Transaction Information with any third party.
Do I have to provide you with my consent to proceed?

Where your bank or building society have already permitted access to your Transaction Information you shall need to contact them directly in order to withdraw your consent under their particular Open Banking terms and conditions.
Under Open Banking as your personal data is shared by your bank or building society and accessed by PDS you may also be able to exercise your individual data protection and privacy rights against either of them pursuant to their own terms and conditions and privacy policies

3) How we use your information

3.2.5 if we are unable to offer you a loan, we will pass your information to other carefully selected brokers (intermediaries) that will attempt to offer loan products offering between £100 and £5000, inside or outside the EU, price comparison websites to enable the comparison of loan products, credit reports to help understand credit ratings and make informed credit decisions. They will not use your information for any other marketing purposes without your consent.
Further credit checks may be run to ensure the suitability with the credit that may be offered. Should this introduction be successful, Emergency Cash Limited would receive a fee from the intermediary.

3.2.6 send to you our newsletter and other marketing communications relating to our business, which we think may be of interest to you, by post email or similar technology. Emergency Cash Limited has two trading names, Wizzcash.com and MustCompare.co.uk You can inform at any time should you no longer wish to receive marketing communication for this purpose. We will not pass on your information to third parties for marketing communications unless you have consented for us to do so;
3.2.7 provide third parties with statistical information about our users – but this information will not be used to identify any individual user. From time to time we might provide third parties with information about our users for specific purposes of statistical analyses to strengthen our internal decision process;
3.2.8 deal with enquiries and complaints made by or about you relating to the website
3.2.9 keep the website secure and prevent fraud;
3.2.10 manage your account and make collections;
3.2.11 develop, improve and update our products;
3.2.12 conduct statistical analysis;
3.2.13 notify you about changes to our service;

4) Storing your personal data
4.1 We will store and process your information securely as we deem appropriate, for example on our computers and servers for a reasonable period at least for the period required by law.
If you have asked that we do not use your details for marketing purposes, we may still need to keep them to ensure our systems reflect your preferences.
Applications that have been declined or are cancelled will generally be kept for a minimum of six years from the end of the application unless you had a successful application with us.
Information about you linked to successful applications will be kept for as long as it is necessary for us to do so to comply with the law, or where appropriate for legitimate business needs and for the establishment, exercise or defence on legal claims.
4.2 All information you provide to us is, as far as reasonably practicable, is stored on our secure servers. Any financial information, such as credit/debit card numbers will be encrypted using specific security software. We ask you not to permit anyone to use your name.
4.3 In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. Further information is provided below under heading 5, “Security”.
5.1 When you enter our Site after the first occasion and want to check your account, we will check your identity by asking for a unique Personal Identification Number (“PIN”). This PIN will be randomly generated and sent to your mobile phone via SMS when you first register with our Site. As long as the correct PIN is entered along with a password chosen by you at the time of registering, we will assume that you are the person giving instructions and making transactions and you will be liable for those transactions.
5.2 You must never tell another individual your PIN, (nor your password or any other codes that protect access to your account) or write them down without disguising them.
5.3 You must tell us immediately if you suspect that someone else knows your PIN or password or can use your account with us by impersonating you. Until you tell us:
5.3.1 you will be responsible for any instruction which we receive and act on, even if it was not given by you; and
5.3.2 we will not be responsible for any unauthorised access to confidential information about you on our website.
5.4 Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our Site; any transmission is at your own risk. Once we have received your personal data, we will use strict procedures and security features to try to prevent unauthorized access.
5.5 Our site may, from time to time, contain links to and from the websites of our advertisers and affiliates. 6) Disclosure of your information
6.1 We may disclose your personal information to third parties:
6.1.1 to process your loan application, or any of the services you have requested.
6.1.2 to prepare or send any communications to you.
6.1.3 to assist us in connection with any of our administrative or business functions, or in the provision of any of our services to you.
6.1.4 if Emergency Cash Limited or substantially all of its assets, are acquired by a third party, in which case personal data held by us about our customers will be one of the transferred assets.
6.1.5 if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our Website Terms and Conditions of Use www.wizzcash.com and other agreements; or to protect the rights, property, or safety of Emergency Cash Limited, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud prevention and credit risk reduction.
6.2 We may give information about you and how you manage your account to the following:
6.2.1 law enforcement agencies in circumstances where we are required to do so by law;
6.2.2 persons and legal entities which provide a service to us or are acting as our agents, on the understanding that they will keep the information confidential; and
6.2.3 CRAs and FPAs (see Clause 10 below).
7) An explanation of what cookies are and how we use them
7.1 A cookie is a small file which asks permission to be placed on your computer’s hard drive. Once you agree, the file is added and the cookie helps web applications to respond to you as an individual by gathering and remembering information about your preferences and which pages you visit. Some cookies only exist whilst users are online but persistent cookies – which are not session-based – remain on the user’s computer, so that he or she can be recognised as a previous visitor when he or she next visits our website. A cookie in no way gives us access to your computer or any information about you, other than the information you choose to share with us.
7.3 We do not store sensitive information such as account numbers or passwords in persistent cookies, and cookies in themselves, do not contain enough information to identify you.

9) Your rights
9.1 You have the right, under section 7 of the Act, to access information held about you. 9.2 In order to ensure fair and transparent processing, if you have been automatically refused a loan from us, you have the right to obtain an explanation of the decision reached after such assessment and to challenge the decision by writing to us if you would like further information on your decision. Please be aware that further credit checks might be run if we need to reassess your application.

10) Credit reference and fraud prevention
10.1 When you apply for a loan or other financial product we may offer, you confirm that all the information you have given is true and complete. You authorise us to check the following records about you and others:
(a) our own;
(b) those at CRAs; and
(c) those at FPAs.
10.2 In order to process your application, we will perform credit and identity checks on you with one or more credit reference agencies (“CRAs”).
To do this, we will supply your personal information to CRAs and they will give us information about you. This will include information from your credit application and about your financial situation and financial history. CRAs will supply to us both public (including the electoral register) and shared credit, financial situation and financial history information and fraud prevention information. In accordance with our responsible lending policy (see Clause 11 below). We may also make periodic searches at CRAs and FPAs to verify your identity and to manage your account with us.
10.3 Information on loan applications and details of your agreement(s) with us and any default or suspected fraud will be sent to CRAs and FPAs and will be recorded by them. This information may be supplied to other organisations by CRAs and FPAs and may be used and searched by us and other organisations in order to:
10.3.1 consider applications for credit and credit related services such as insurance for you and any associated person;
10.3.2 prevent or detect criminal activity, fraud and money laundering;
10.3.3 trace debtors or recover debts;
10.3.4 assess your creditworthiness and whether you can afford to take the product;
10.3.5 verify the accuracy of the data you have provided to us;
10.3.6 manage your accounts;
10.3.7 ensure any offers provided to you are appropriate to your circumstances.
10.4 We will continue to exchange information about you with CRAs while you have a relationship with us. We will also inform the CRAs about your settled accounts. If you borrow and do not repay in full and on time, CRAs will record the outstanding debt. This information may be supplied to other organisations by CRAs.
10.5 When CRAs receive a search from us they will place a search footprint on your credit file that may be seen by other lenders.
10.6 If you have a spouse or financial associate, CRAs might will link your records together with them, so you should make sure you discuss this with them, and share with them this information, before lodging the application. CRAs will link associates or spouse records together and these links will remain on your and their files until such time as you or your partner successfully files for a disassociation with the CRAs to break that link.
10.7 Records remain on file with CRAs and FPAs for 6 years after they are closed, whether settled by you or defaulted.
